California legislative update:  Two bills passed on 9.2.25 (AB 49 and SB 98)

AB 49  California Safe Havens Act (Long list of supporters, including San Diego Unified School District).This bill, an urgency measure, prohibits local educational agencies (LEAs) from allowing immigration enforcement officers to enter nonpublic areas of a schoolsite without providing a valid judicial warrant, judicial subpoena, or court order. SB 98  PerezSchool safety plan to notify parents of ICE presence1) Requires when a comprehensive school safety plan is next reviewed on or before March 1, 2026 through January 1, 2031, it include procedures to notify parents,  guardians, school personnel when the school confirms the presence of immigration enforcement. 2) Requires the content and timing of the notification to consider the safety and well-being of the students and others on the schoolsite in the issuing of such notifications. 3) Authorizes the notification to include a hyperlink to additional resources for families with information about their educational rights, state laws that protect parents′ and students′ privacy and confidentiality, and, if available, counseling or support services. 4) Applies the notification requirements to charter schools through January 1, 2031. 5) Requires the CSU Trustees, each CCD governing board, and an independent institution of higher education that is a Cal Grant qualifying institution, through January 1, 2031, to notify all students, and others on campus when the presence of immigration enforcement at a campus is confirmed9.2.25Passed– to engrossing and enrolling (then to go to Governor)

 SB 627  (Masks)1) Prohibits a peace officer and any officer or agent of a federal law enforcement agency, or any person acting on behalf of a federal law enforcement agency, from wearing a facial covering in the performance of their duties. 2) Makes a first violation an infraction, and a second or subsequent violation a misdemeanor. 3) Defines “facial covering” for the purposes of this bill…defines exceptions (Under Cover Operations, SWAT teams), …7) Requires a state or local law enforcement agency (LEA), on or before July 1, 2026, to adopt policies regulating the use of facial coverings.  Requires state, local, and federal law enforcement agencies, before undertaking operations that are reasonably likely to involve agency personnel wearing facial coverings in the performance of their duties, to provide advance notice to the LEA with jurisdiction over the location where the operation takes place5.8.25 7.15.25  8.20.25 Next:9.3.25Passed in Senate 36-0 (Jones voted Yes)Passed, as amended,  Assembly  Public Safety CommitteePassed Assmbly Approp  Assmbly         `
